Terms of Service

1. Acceptance of terms

By creating an account or using The Crate, you agree to these Terms of Service. If you are using The Crate on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

2. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account. The Crate uses passwordless authentication via magic links sent to your registered email.

There are two account types: Label accounts (for record labels and PR teams) and DJ accounts (for DJs and artists receiving promos). Each account type has access to different features.

3. Label accounts and content

Labels are responsible for ensuring they have the right to distribute any audio content they upload to The Crate. By uploading tracks, you confirm that you own or have been granted the necessary rights to distribute this content for promotional purposes.

Labels may need approval before sending promos. We reserve the right to review and approve or reject label accounts to maintain the quality and integrity of the platform.

4. DJ accounts and content use

Promo tracks received through The Crate are for personal preview and DJ performance use only. You may not redistribute, resell, upload to streaming platforms, or publicly share promo tracks without explicit written permission from the label.

Audio streams and downloads may be watermarked with your identity. Unauthorized distribution of watermarked content may result in account suspension and legal action by the rights holder.

5. Feedback and play data

Feedback you submit on promos and play data you report (gigs, crowd reactions, track plays) is shared with the label that sent the promo. This data helps labels understand how their music performs in real-world settings.

By submitting feedback and play data, you grant labels a non-exclusive right to use this information for promotional and marketing purposes.

6. Tier system

DJ accounts are assigned a status tier based on activity, engagement, and feedback quality. Tiers are recalculated periodically based on your monthly review submissions, play logs, gig reports, and overall platform engagement. Higher tiers may unlock access to exclusive content and priority placement.

7. Subscriptions and billing

Label accounts may require a paid subscription for full access. Subscriptions are billed monthly or annually through Stripe. You can manage your subscription and cancel at any time through the billing settings in your dashboard.

DJ accounts are free. There is no cost for DJs to receive promos, provide feedback, or use the platform.

8. Acceptable use

You agree not to:

• Use The Crate to distribute content you do not have rights to
• Redistribute or leak pre-release promo tracks
• Create multiple accounts to circumvent subscription limits
• Automate access to the platform without permission
• Submit false or misleading feedback or play data
• Attempt to access other users' accounts or data

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting us. Upon termination, your access to promos and uploaded content will be revoked.

10. Limitation of liability

The Crate is provided on an “as is” basis. We make no warranties regarding the availability, reliability, or accuracy of the platform. We are not liable for any damages arising from your use of The Crate, including but not limited to loss of data, unauthorized distribution of content, or interruptions in service.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through a notice on the platform. Your continued use of The Crate after changes are posted constitutes acceptance of the updated terms.
